In our opinion, Lasting Powers of Attorney (LPAs) are just as important for a couple as having a Protective Property Will Trust in place to protect their assets.
A LPA is a legal agreement designed to protect people who in the future may lack mental capacity to make decisions about important matters such as their financial affairs, their care and health treatment.
LPAs give a trusted family member the power to make decisions if a loved one loses capacity to make their own decisions.
The consequences of not having a LPA in place is that important decisions cannot be made without the consent of the Court of Protection. Unfortunately there is considerable expense involved if an application has to be made to the Court of Protection and a deputy’s powers are very limited compared to someone who has been appointed an Attorney.
